The spectator chooses any card in the deck (free choice) and puts it back into the deck themselves. The magician never touches the cards

The spectator chooses any random number

The spectator takes the first deck (which the magician still hasn’t touched) and counts down that number of cards

The card is at that number. EVERY TIME.
